By visiting our site MINTTNIM.COM and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms of Service at any time on this page. We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

1. Service Description

We provide personalized jewelry customization services. Users may upload original artwork, doodles, or other image files created by themselves or their children (“User Materials”). Based on the submitted materials, we design and produce customized enamel jewelry products such as necklaces and bracelets (“Customized Products”).
Important Note: Customized Products are inherently personalized. Once an order is confirmed and enters production, special return and exchange policies apply (see Section 6).

2. User Accounts and Eligibility

2.1 Eligibility Requirements

You must be at least 18 years old (or the legal age of majority in your jurisdiction, whichever is higher) to use this service. By using the service or placing an order, you represent and warrant that you meet this age requirement.

Minors: If you are under 18, you may only use this website under the supervision of a parent or legal guardian. We reserve the right to request proof of age.

2.2 Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials (including username, password, security answers) and for all activities under your account (including unauthorized use).
You agree to:

Log out after each session;
Notify us immediately of any known or suspected unauthorized use or security breach;
Use strong passwords and update them regularly.

We are not liable for any loss or damage arising from your failure to comply with these obligations.

2.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without reason or prior notice, including but not limited to:

Violation of any terms of service;
Uploading infringing or illegal content;
Fraudulent, abusive, or suspicious activity;
Security, legal, or regulatory concerns;
Other circumstances we deem necessary.

Upon termination, you will lose access to order history, uploaded materials, and other account data. Paid orders not yet in production will be handled in accordance with Section 6.

3. Service Details

3.1 Receipt and Review of User Materials

Users upload artwork, doodles, or images via designated channels. We reserve the right to review materials for clarity, recognizability, and manufacturability. Materials failing review may require resubmission, or the order may be canceled with a full refund.

3.2 Design Conversion and Production

We convert core visual elements of User Materials (lines, shapes, colors, etc.) into designs suitable for our jewelry production process.
Users understand and agree that:

The final product may differ reasonably in color, detail, or proportion from the original material;
Overly complex or unclear materials may not be fully reproducible;
Adjustments made for production purposes do not constitute quality defects.

3.3 Delivery of Customized Products

Completed products are shipped to the address provided in your order. All production is completed in China, with international shipping to the customer. Delivery times are as indicated in the order confirmation or shipping information.

3.4 Cross-Border Transaction Notice

EU: Order prices do not include VAT; customers may be responsible for VAT collection by customs or logistics.
USA: Sales tax may vary by state and will be calculated at checkout based on shipping address.
Customs and Import Duties: Customers are responsible for any customs duties, import taxes, and clearance fees. We are not liable for additional costs or delays caused by destination country policies.

4. Service Modifications and Termination

We reserve the right at any time, without notice, to:

Modify, suspend, or terminate the service or any portion thereof;
Stop accepting certain types of customization requests;
Suspend the sale of certain product types;
Adjust review standards and production feasibility criteria;
Change design implementation methods, materials, or production processes;
Adjust delivery times or service scope.

Such rights apply to all aspects of the service, whether or not users are notified. We are not liable for any losses or inconveniences resulting from such changes, except that ongoing orders already in production will not be retroactively affected.

5. Third-Party Platforms

5.1 Shopify Platform

This website is powered by Shopify Inc. and operates on the Shopify e-commerce platform. Your use is also subject to Shopify’s Terms of Service and Privacy Policy, available on Shopify’s official website.

5.2 Payment Services

Payments are processed by third-party providers (including but not limited to Shopify Payments, PayPal, Stripe). We do not store complete payment card information. Any issues during payment should be resolved with the relevant payment provider first.

5.3 Shipping Services

Delivery is provided by third-party logistics providers. We are not liable for:

Delays caused by logistics providers;
Lost, stolen, or damaged packages (we will assist with claims);
Incorrect delivery due to user-provided addresses;
Customs delays, seizures, or returns.

5.4 Disclaimer

To the maximum extent permitted by law, we are not liable for actions, negligence, or breaches by third-party platforms, payment, or logistics providers. By using these services, you agree to their terms and conditions.

6. Returns and Refund Policy

6.1 Nature of Customized Products

Customized Products are made to individual specifications and are inherently personalized. Accordingly, they are not eligible for a change-of-mind return under the following laws:

EU: Under Directive 2011/83/EU Article 16(c) and ECJ case C-529/19 (Möbel Kraft), products made to consumer specifications or clearly personalized are exempt from the 14-day withdrawal right.
USA: Federal and state laws do not require merchants to accept returns for change of mind. “Final Sale” policies are valid if clearly disclosed.

6.2 Order Cancellation Policy

Within 24 hours of confirmation: Full refund available upon request.
After 24 hours, before production starts: May be handled case by case; we reserve the right to refuse.
Once production begins: Orders cannot be canceled. “Change-of-mind” returns do not apply.

6.3 Quality Issues and Production Defects

If there is a significant production defect (excluding design differences or reasonable craft variations), contact us within 14 days with:

Order number;
Clear photos of the defect (at least 2);
Optional unboxing video.

We may offer:

Reproduction: Free remaking and shipment for confirmed serious defects;
Partial Refund: 30%-70% of product value if defect is irreparable but does not affect basic functionality;
Full Refund: For severe irreparable defects, full refund without return of the product.

6.4 Non-Quality Issues

Not eligible for return or refund:

Subjective differences in design expectations;
Differences caused by clarity or color of uploaded material;
Incorrect delivery address;
Normal wear and tear.

6.5 California Notice

Under California law, if “Final Sale” policies are not prominently disclosed (e.g., large font, bright colors), California consumers may not be bound by the policy.

6.6 Refund Processing

Refunds will be issued to the original payment method within 14 business days after confirmation.

7. Product Risks and Safety Warnings

Important Safety Information – Read Carefully

7.1 Choking Hazard – Small Parts

Products contain small parts such as pendants, charms, rings, beads, etc.
Warning: Not suitable for children under 3. Keep out of reach of children and pets.

7.2 Ingestion Risk

Swallowing small parts may cause serious injury or death. Seek immediate medical attention if ingestion occurs.

7.3 Allergy Risk

Products may contain: metals (silver, enamel, stainless steel, brass, plated metals), resin, plastic, acrylic, leather, fabric, or cords.
Evaluate carefully if allergic to any materials. We are not liable for allergy-related damages.

7.4 Wearing Safety

Remove during sleep, sports, swimming, showering, or vigorous activity;
Pendants or connectors may catch on objects;
Stop wearing if skin irritation occurs.

7.5 General Safety

Jewelry is decorative, not a toy;
Do not chew or put in mouth;
Stop using if damaged;
Regularly inspect for wear or loose parts.

7.6 Disclaimer

This list is not exhaustive. Users acknowledge inherent risks in wearing jewelry. We have made reasonable efforts to notify known risks but are not liable for injuries or losses from misuse.

8. User Responsibilities and License

8.1 Legality of Materials

Users guarantee that uploaded materials:

Are original or authorized;
Do not infringe third-party IP, privacy, or other rights;
Do not contain illegal, obscene, violent, or discriminatory content.

Users are liable for any claims, lawsuits, or penalties arising from infringing materials.

8.2 License Grant

By uploading materials, you grant us a non-exclusive, irrevocable license to use the materials for production and necessary display, including adjustments, adaptations, and optimization. This license continues after termination of these terms to complete orders already in production.

9. Data Privacy and GDPR Compliance

9.1 Data Collection

Via Shopify, we collect:

Name, email, shipping address, phone;
Uploaded user materials;
Payment info (processed by providers, we do not store full card info).

9.2 Data Roles

Merchant (us): Data controller;
Shopify: Data processor.

9.3 International Data Transfers

Data may be transferred to: Canada, Ireland, Singapore, USA. Transfers comply with applicable data protection laws, including EU Standard Contractual Clauses.

9.4 User Rights

Depending on your region, you may have: access, correction, deletion, restriction, portability, objection rights. Requests can be submitted via Section 14.

9.5 Cookies and Tracking

Necessary cookies for shopping cart and checkout are used. EU users must consent to non-essential analytics cookies, which can be revoked anytime.

9.6 Data Retention

Personal data retained for order fulfillment and legal compliance. User Materials are deleted 30 days after production completion.

10. Intellectual Property

10.1 Our IP

All website content (text, images, logos, designs, source code) is owned or licensed by us. No copying or commercial use without written permission.

10.2 User Material IP

Users retain ownership. Uploading grants us a limited license for production only. No commercial use outside of order fulfillment.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

Legal consequences of infringing or illegal uploads;
Design expectation differences;
Delivery delays or failures beyond our control (customs, force majeure, logistics strikes);
Failure to provide customs clearance documents;
Injuries from ignoring safety warnings;
Indirect, incidental, punitive losses.

Liability Cap: Maximum liability per order is the total amount paid for that order.

12. Indemnification

You agree to indemnify and hold our affiliates, officers, employees, and agents harmless from claims, damages, losses, and expenses (including reasonable attorney fees) arising from:

Violation of terms;
Infringing user materials;
Improper use of products;
Violation of laws.

13. Governing Law and Dispute Resolution

13.1 Governing Law

EU users: Law of your member state, preserving mandatory consumer protections;
US users: Our state law, under federal arbitration rules;
Other regions: Law of [Merchant Country/Region].

13.2 Dispute Resolution

Attempt amicable resolution via Section 14 email.

EU users: May contact local consumer dispute bodies. Online ODR platform: https://ec.europa.eu/consumers/odr
US users: Binding arbitration or small claims court; class actions waived.

13.3 EU Consumer Withdrawal Exception

Customized/personalized products are exempt from 14-day withdrawal. Consult local consumer authorities before ordering if in doubt (see Section 6.1).

14. Amendments

We may modify these Terms at any time. Updated terms take effect upon posting at MINTTNIM.COM. For existing users, changes take effect with reasonable notice. Major changes (e.g., refund policy) will be announced via website or email.
